This project really stinks.
As a former consultant, it is illegal to bypass the NEPA process and that is exactly what has happened.
No doubt this project would require an EIS because of" the potential for significant environmental impact."
With the EIS, comes the requirement for public input.
This project breaches the Law and the Public Trust.

This has been a reasonable discussion sticking to the issues, not the politics, of a proposed project that is controversial.

If that's so, the project will be halted by the courts in an appropriate lawsuit. Related to the current scope of NEPA, as I discussed in another thread, in May 2025 a unanimous Supreme Court of the United States, in the case Seven County Infrastructure Coalition v. Eagle County, Colorado, significantly narrowed the circumstances under which NEPA can be used to block projects having environmental impacts.
